Which path are you on?

How the home gets sold depends on how it was left. Here are the three most common situations in California. Your attorney will confirm which one applies.

Probate

The home was in the person’s name alone, with no trust. A court appoints an executor or administrator, who can usually sell the home during probate, sometimes with court confirmation.

Living trust

The home was held in a trust. The successor trustee can usually sell without going to court, which is often much faster.

Smaller estates and other transfers

Some estates qualify for simplified court procedures, and homes held in joint tenancy may pass directly to the surviving owner.

How it works

Selling a probate home, step by step

Probate in California often takes 9–18 months from start to finish. The house sale is one piece of it, and I’ll make that piece easy.

Free walkthrough and home value

I visit the property (or video-tour it for you if you’re out of town) and give you a realistic market value. Executors often need this early on.

Secure and protect the home

Change the locks, check insurance, keep utilities on and keep an eye on the place so it stays safe while things get sorted.

Sort, clean out and prep

Family takes what matters. Then estate sale, donation and cleanout crews handle the rest. We fix only what pays off.

List, market and negotiate

Pro photos and full marketing to bring strong offers. I work hand in hand with your probate attorney on any court requirements.

Close and distribute

Escrow closes, the attorney handles the estate funds, and you’re done. One less thing on your shoulders.

Honest options

List it, or take a cash offer?

You’ve probably gotten “we buy houses” letters already. Cash offers can be the right call. Just know the trade-off first.

List on the marketSell as-is for cash
PriceUsually the highest, which means more for the estate and the heirsLower. Cash buyers typically offer well below market value
TimelineOften 30–60 days once listedCan close in a week or two

Court confirmationHandled with your attorney if requiredAlso required in some probates. Fast offers can still face court timelines

I’ll get you real numbers for both paths on your specific home. If cash is truly the better deal, I’ll tell you.

The money stuff

Taxes and costs to know about

Stepped-up basis

Inherited homes usually get a “stepped-up” tax basis to the value at the date of death, which can greatly reduce capital gains tax if you sell soon after.

Prop 19

If an heir wants to keep the home, Prop 19 changed the property tax rules. Keeping the low tax base now generally requires the child to live there as their primary home.

Upfront costs

Prep and cleanout can often be coordinated so they’re paid from the sale at closing, not out of your pocket. Ask me how.

I’m a real estate agent, not an attorney or tax advisor. Please confirm these with your probate attorney or CPA. I’m happy to introduce you to trusted local ones.

Questions heirs ask

Inherited & probate home FAQ

Can a house be sold while it’s in probate in California?

Yes. The executor or administrator can usually sell during probate. Depending on the court’s authority level, the sale may need court confirmation, which can include a public overbid at the hearing. Your attorney will know which applies.

How long does probate take in San Bernardino, Riverside or LA County?

Many California probates take about 9–18 months, depending on the estate and court schedules. The home can often be sold before probate fully closes.

Do I have to fix up or clean out an inherited house before selling?

No. You can sell as-is. But a cleanout and a few smart fixes often bring a noticeably higher price. I’ll show you the numbers both ways.

I live out of state. Can I still sell my parent’s house?

Yes. Most documents can be signed remotely, and I handle the local work: access, vendors, showings and updates by phone or video.

What if my siblings disagree about selling?

It’s common. I can give everyone the same clear information, including value, options and costs, which usually makes agreement easier. For legal disputes, your attorney is the right guide.

Do I pay taxes when I sell an inherited home?

Often very little, thanks to the stepped-up basis, especially if you sell soon after inheriting. Every situation is different, so check with a CPA.
